WHAT IS LEGAL PROJECT MANAGEMENT ("LPM") AND HOW DOES IT HELP?

It is the application of project management principles to the delivery of legal services, which allows firms to plan, manage and resolve legal matters successfully (whether litigation or transactional work), on time and on budget. This in turn, allows firms to better asses risk and explore alternative fee arrangements.

WHY IS LPM PARTICULARLY IMPORTANT IN MEXICO AND LATIN AMERICA?

Legal systems from Mexico and most other countries in Latin America are strikingly different from those of North America. A range of factors contribute to this unique legal landscape, which influences the way legal services are offered and delivered by legal professionals in the region. These unique differences should always be accounted for on any legal project to set realistic expectations.

WHAT FACTORS WILL YOU CONSIDER FOR LITIGATION IN LATIN AMERICA, AND HOW DOES LPM HELP?

Not all claims are good candidates for litigation. Some of the issues that creditors should address before deciding to sue are the following: 1) costs and rewards; 2) risks; and 3) legal strategy. First, put simply, the cost of litigation has to make business sense. Second, you need to make sure that not only you are well equipped to win a case, but to enforce a judgment effectively. And third, you need to partner with the right professional (reliable and trustworthy) and come up with the right action and follow through. This last part is where LPM is key.

WHAT WOULD BE A BASIC GOOD PRACTICE OF LPM FOR LITIGATION?

A good practice requires that your attorney explains in detail the type of case or legal proceeding that he will file, what does this accomplish, evidence required, risks involved, and the overall strategy designed to win the case and execute in full. While you may not be an expert, the effort to gain basic knowledge of the legal landscape will pay dividends when teaming up with your lawyer in setting up the best strategy. Finally, you should discuss exit strategies with your lawyer to keep costs under control, under worst-case scenarios.
